These terms & conditions describe how Bakuun outlines the following terms in the relationship between the ‘Site’ and the "Customer".
Bakuun owns and operates the Site. Bakuun, its licensors or its third-party content provider partners are the owners of all material displayed or featured on the Site, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software and the selection and arrangement thereof ("Bakuun Content"). Bakuun and all other elements of the Site are protected by copyright, trade dress, moral rights, trademarks, and other laws relating to the protection of intellectual property.
The "Bakuun Content" consists of the hotel and travel related text, data, images, videos, and other media that Bakuun distributes to its distribution clients who have signed a valid distribution licensing agreement with Bakuun (“Authorized Licensees”) and are, therefore, authorized to use Bakuun Content in accordance with the license agreement.
Any use of Bakuun Content by a party ("User") is subject to the following requirements and restrictions, unless specifically stated otherwise in an Authorized Licensee's written agreement with Bakuun:
Bakuun Content may not be used for trademarks or service marks, or for any pornographic or unlawful purpose or use, or to defame anyone, or to violate anyone's right of privacy or publicity, or to infringe upon any copyright, trade name, trademark, or service mark of any person or entity.
Any derivative use of Bakuun Content is prohibited. In no event may the Bakuun Content be sublicensed, re-licensed, rented or leased.
There shall be no archiving, republishing, transmission of Bakuun Content on any network or bulletin board, or for any other use by anyone other than the Authorized Licensees, without the prior written consent of Bakuun.
Any use of Bakuun Content by an unauthorized user ("Unauthorized User") constitutes copyright infringement, entitling Bakuun to exercise all rights and remedies available to it under copyright laws around the world, such as an injunction preventing further use or monetary damages, including claims by a third party.
Bakuun Content and the site are intended for Bakuun customers. The Site or the Bakuun Content may not be used for any purpose other than your business with Bakuun. In particular, you are not permitted to:
(a) download, copy, or re-transmit any or all of the Bakuun Content without a license or agreement written with Bakuun;
(b) use any data mining, robots, or similar methods for gathering or extracting data;
(c) alter, manipulate, or otherwise display the Site or Bakuun Content through the use of framing or similar navigational technology;
(d) register, subscribe, unsubscribe or attempt to register, subscribe, unsubscribe any party for any Bakuun product or service without the express authorization of that party;
(e) modify, alter or reverse engineer any portion of the Site or the Bakuun Content;
(f) attempt to circumvent, disable, or interfere with security-related features of the Site or any system resources, services, or networks connected to or accessible through the Site;
(g) to sell, license, lease, or otherwise commercialize the Bakuun Content, or the Site, in any way without explicit written permission from Bakuun; and
(h) use the Site or the Bakuun Content otherwise than as intended. Such unauthorized use might also be in violation of other laws, including without limitation copyright and trademark laws, laws of privacy and publicity, and applicable communication statutes and regulations.
In no event shall Bakuun, its directors, members, employees or agents be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the site, the services, the Bakuun content or the materials contained in or accessed through the site, including without limitation any damages caused by or resulting from reliance by user on any information obtained from Bakuun, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Bakuun’s records, programmes or services. In no event shall the aggregate liability of Bakuun, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the site exceed any compensation you pay, if any, to Bakuun for access to or use of the site.
Bakuun reserves the right to terminate your account and/or block your use of the Site without notice and at its sole discretion.
Any waiver of any term of the Site Terms must be in writing and signed by Bakuun. Wherever possible, if any of these Site Terms were found to be unenforceable, this would not affect any other clause and each would remain in full force and effect. We reserve all rights not expressly granted herein.
Bakuun reserves the right to make any changes to the Site Terms at any time and at its sole discretion. Those changes will become effective immediately upon being posted on the Site. Your continued use of the Site following the posting of changes will constitute your acceptance of such changes. Each time you visit one of our websites, we encourage you to review the Site Terms.

The Site must not be used in any way that diminishes, damages, or harms it in any way, or that violates any applicable rules and regulations.
It is not permitted to use any automatic device, process, or any other method to access the Site for any purpose, including monitoring or copying its content, or launching any viruses, trojan horses, worms, or other malicious software.
We may report the above activities to the authorities and we will coordinate with them by disclosing any of your data. In any event of breach, your right to use the Site will be terminated immediately.
